NEADVANCE IS COMMITTED TO PROTECTING THE PRIVACY AND PERSONAL DATA OF ITS CUSTOMERS AND SITE USERS, THEREFORE IT HAS PREPARED AND ADOPTED THIS POLICY AND THE PRACTICES DESCRIBED HEREIN. THIS PRIVACY AND COOKIE POLICY EXPLAINS HOW YOUR PERSONAL DATA IS COLLECTED AND PROCESSED, THEREFORE WE ADVISE YOU TO READ IT TO FIND OUT THE CONDITIONS UNDER WHICH YOUR PERSONAL DATA IS COLLECTED AND USED.

Through this Privacy and Cookies Policy, Neadvance informs its customers, employees and other interested parties regarding the treatment it carries out with their data, as well as the rights it recognizes as holders of personal data. Neadvance acts in strict accordance with the principles described in this policy, Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and applicable data protection legislation, in all personal data processing activities that are your responsibility. Neadvance processes personal data through various operational and technical means that serve as support for its business process activities.

1.1. The Privacy Policy, as a communication instrument, has the following main objectives:

a) Strengthen and consolidate Neadvance’s relationship of trust and proximity with its Customers;

b) Demonstrate transparency in the processing of personal data carried out by Neadvance;

c) Inform Customers, Employees and Stakeholders of their rights, as holders of personal data, and how they can exercise them;

d) Inform Customers, Employees and Stakeholders about Neadvance’s Persons Responsible to whom they can request the exercise of their rights, or clarify how their personal data is treated;

e) The Privacy and Cookies Policy is complemented by the internal document GDPR Manual, for internal procedures at Neadvance, in relation to the GDPR theme.

2.1. This Privacy and Cookies Policy explains how we collect and process personal data that is necessary to provide services that are available through the WEBSITE, describing the practices adopted for this purpose.

2.2. This policy applies exclusively to the processing of personal data carried out by NEADVANCE, in the context of the intended purposes.

5.1. NEADVANCE will use the personal data collected through your use of the Website that you provide to us for the following purposes:

17.1. Your personal data is kept safe through the adoption of various technical and organizational security measures that ensure that only Employees and the processes that must access them have access to personal data, in accordance with rules created for this purpose.

17.2. To protect your personal data, we only use data center providers that offer us adequate and documented security measures, that is, guarantees that your personal data is stored on servers that are kept in controlled environments with limited access.

17.3. Personal data is kept on secure website servers at Hostinger International, Ltd (www.hostinger.com), which offers us adequate security guarantees to protect personal data against dissemination, loss, misuse, alteration , unauthorized processing or access, as well as against any other form of illicit processing.

17.4. Likewise, when you browse the WEBSITE, we protect your data with encryption, such as Secure Sockets Layer (SSL, is a security protocol that protects telecommunications via the internet). Our website is considered secure by HTTPS.

17.5. Although we take the care and precautions we deem appropriate to protect the personal data you provide to us and we collect, you should be aware that no security system is impenetrable.

18.1. Your personal data will only be kept for as long as necessary for the purposes for which they are intended, as listed in this Privacy and Cookies Policy, and within legal limits, as follows:

18.2. If any specific or mandatory period results from the law, the data retention period will be that. In all other cases, personal data will be kept for a maximum of the times indicated above, periods that NEADVANCE understands as sufficient to fulfill the purposes.

18.3. Once the defined retention period has expired, NEADVANCE undertakes to delete, destroy or anonymize your personal data.

18.4. In relation to the video surveillance in the Neadvance building, we only retain your personal data for a period of 30 days, as required by law.

18.5. You can request additional information regarding the retention periods for your personal data by emailing RGPD@neadvance.com.

19.1. Before we explain how you can exercise your rights, it is worth knowing what they are. Therefore, the legislation gives you the right to request us to exercise the following rights:

a) Access: right to obtain confirmation as to whether or not personal data concerning you are being processed and, if applicable, the right to access your personal data;

b) Rectification: the right to obtain the rectification of inaccurate personal data concerning you and to have your incomplete personal data completed;

c) Erasure: the right to obtain the erasure of your personal data when one of the reasons listed in the legislation applies;

19.2. You also have the right to lodge a complaint with the competent supervisory authority (in Portugal, the National Data Protection Commission at www.cnpd.pt)

19.4. If you ask us to delete some or all of your personal data, some of the requested services may not be provided to you and NEADVANCE will only keep the personal data necessary to comply with the legal obligations to which it is bound.

20.1. NEADVANCE may use third parties to provide certain services, in terms of maintenance, technical support, marketing, billing or payment management, and they may have access to some of the personal data, in particular, the data necessary for the contracted purposes.

20.2. NEADVANCE ensures that the entities that have access to the data are credible and offer high guarantees of protection, with no data being transmitted to them beyond what is necessary to provide the contracted service, however, NEADVANCE remains responsible for the personal data made available.

20.3. For example, for data center management purposes, NEADVANCE uses services from Hostinger, WordPress and HubSpot.

20.4. NEADVANCE may also communicate your data to the following entities:

a) Companies from the business group to which NEADVANCE belongs and with which it has commercial partnerships to create and offer benefits; or yet,

b) Other partners outside your business group (with your prior authorization).

20.5. NEADVANCE may also transmit data to third parties within the scope of investigations, inquiries and judicial and/or administrative proceedings or of a similar nature, as long as it is duly ordered by a court order to that effect.

21.1. The WEBSITE may contain links to other websites which may collect and process your personal data, and this processing is the sole responsibility of the owners of these websites, with NEADVANCE having no responsibility for their policies and/or practices.

21.2. An example of these third parties are links to social networks such as Facebook, X (Twitter), LinkedIn or Google (Youtube) through the buttons present on the WEBSITE.

22.1. If data transfers to third countries that do not belong to the European Union may occur, NEADVANCE will comply with legal rules, particularly with regard to the adequacy of the destination country with regard to the protection of personal data and the requirements, which are applicable to these transfers, and personal data will not be transferred to jurisdictions that do not offer guarantees of security and protection.

23.1. The WEBSITE is not directed to children under 16, so we ask that these minors do not provide us with personal data through the WEBSITE, application, social networks and social media or emails.

NEADVANCE thanks you for not sending us or making us aware of any sensitive personal data, that is, information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic information, biometric information, health data or data relating to a natural person’s sex life or sexual orientation.
